Jacqueline D. Caya, 37, of Winnebago was convicted of driving while impaired-refuse to submit to chemical test-breath or test refusal or failure; fined $100, sentenced to jail 364 days, stayed 361 days for two years, credit for time served three days, two years supervised probation, sentence to service seven days for indeterminate, contact probation officer as directed, complete and pay for a comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, comply and complete any post-sentence investigation as requested by agent, attend MADD impact panel, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, provide list of prescribed medications to probation officer, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Brandon K. Faber, 27, of Brookings, S.D. was convicted of fourth-degree driving while impaired; fined $610, sentenced to jail 90 days, stayed 90 days for one year, one year supervised probation, attend MADD impact panel and when completed provide proof to agent, complete comprehensive assessment, remain law-abiding, no same or similar. Additional charges of driving while impaired-alcohol concentration 0.08 within two hours, and operate motor vehicle while under the influence of alcohol, were both dismissed.
Linda L. Larson, 49, of Granada received a stay of adjudication on a charge of pharmacy-procure/possess/control legend drugs by deceit, misrepresentation or subterfuge; fined $100, one year supervised probation, contact probation officer as directed, attend five counseling sessions with licensed therapist then file can be closed and probation terminated, no new violations of the law, take medications in the prescribed dosage and frequency, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives.
Edgardo A. Umana, 43, of Champlin was convicted of driving after cancellation-inimical to public safety; fined $185, sentenced to jail 115 days, credit for time served 77 days. Additional charges of fifth-degree controlled substance possession-not small amount of marijuana, and possession of drug paraphernalia-use or possession prohibited, were both dismissed.
