Bradley A. Merrill, 58, of Albert Lea received a statutory stay of adjudication on a charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $575, sentenced to jail two days, credit for time served two days, one year supervised probation, contact probation officer as directed, pay for and complete comprehensive assessment within 45 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, provide list of prescribed medications to probation officer, cognitive skill training if recommended by probation and follow all recommendations, complete diagnostic assessment if recommended by probation and follow all recommendations, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charges of driving after revocation, and possession of drug paraphernalia-use or possession prohibited, were both dismissed.

Travis S. Runge, 45, of Fairmont received a stay of imposition pursuant to Minnesota statutes on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $1,327.50, restitution $552.50, sentenced to jail 20 days, credit for time served 20 days, five years supervised probation, contact probation officer as directed, pay restitution before fines, fees or surcharges, complete diagnostic assessment and abide by recommendations for care and aftercare, enter and successfully complete Drug Court and cooperate with the referral process and if accepted then successfully complete program, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, no contact with victim(s), don’t enter victim’s residence, provide agent with verification of job search as directed, maintain part-time or full-time employment and if employed for three consecutive months or more then fine can be credited, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Also convicted of trespass-occupy/enter locked dwelling or posted building; sentenced to jail 20 days, credit for time served 20 days. An additional felony charge of third-degree burglary, and misdemeanor charges of fourth-degree damage to property-intentional damage-other circumstances, obstruct legal process-interfere with peace officer, and give peace officer false name/birthdate/ID card, were all dismissed.

Nicholas W. Muyskens, 26, of Bayport was convicted on a felony charge of fleeing a peace officer in a motor vehicle; commit to Commissioner of Corrections 20 months, concurrent with other case, complete post-sentence investigation, give a DNA sample when directed. Additional charges of careless driving-operate any vehicle carelessly on streets or highways, and speeding, were both dismissed.

Roberto Vidal Jr., 27, of Fairmont was convicted of of fifth-degree controlled substance possession-not small amount of marijuana; fined $585, sentenced to jail 365 days, stayed 360 days for one year, credit for time served five days, one year supervised probation, contact probation officer as directed, pay for and complete comprehensive assessment within 60 days of sentencing and follow all recommendations timely, must sign all releases for assessor to obtain collateral information from assigned probation agent(s), assigned social worker(s) if any, mental health treatment provider(s) if any, relevant family/household members and recent treatment providers as part of their assessment, must successfully complete the level of treatment and aftercare recommended rather than choosing a lesser level of care, remain law-abiding, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives if prohibited by law. An additional felony charge of fifth-degree controlled substance sale-marijuana mixture except small amount of marijuana with no remuneration, and possession of drug paraphernalia-use or possession two or more times, were both dismissed.
