Failure of driver to carry proof of insurance when operating a vehicle —

Dustin M. Brown, 30, of Lakota, Iowa was convicted of theft-take/use/transfer movable property without consent; fined $185, sentenced to jail 30 days, stayed 30 days for one year, one year unsupervised probation, restitution reserved if filed the county attorney within 30 days, don’t enter the Fairmont Walmart during the term of this case, no same or similar.

Brady A. Eytcheson, 26, of Fairmont was convicted on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $100, commit to Commissioner of Corrections 24 months, concurrent with other case, give a DNA sample when directed. Two additional felony charges of third-degree controlled substance sale of a narcotic, fourth-degree controlled substance sales but not marijuana, and a misdemeanor charge of introduce contraband-drug/liquor into jail/lockup/prison, were all dismissed.

Devin D. Ibarra, 19, of Trimont was convicted of possess ammo/any firearm-convict/committed drug offense; fined $385, sentenced to jail 365 days, stayed 362 days for two years, credit for time served three days, two years supervised probation, contact probation officer as directed, cognitive skill training if recommended by probation, no same or similar, no mood-altering chemicals, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charges of possess ammo/any firearm-user of controlled substance, possess over 1.4 grans of marijuana in motor vehicle, possess/sale small of amount of marijuana-no remuneration, and possession of drug paraphernalia-use or possession prohibited, were all dismissed.

Christina E. Knight, 18, of Sherburn was convicted of possess over 1.4 grans of marijuana in motor vehicle; fined $150. Also convicted of possession of drug paraphernalia-use or possession prohibited; fined $135.

Jerry E. Mcfarland, 50, of Fenton, Iowa was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $585, sentenced to jail 90 days, stayed 90 days for one year, one year unsupervised probation, complete comprehensive assessment and follow all recommendations, attend MADD impact panel, no same or similar. Additional charges of fourth-degree driving while impaired, operate motor vehicle while under the influence of alcohol, open bottle law-drinking and consumption, failure to drive in a single lane, and speeding, were all dismissed.

David G. Powell, 50, of (homeless) was convicted of no insurance-owner violation; fined $285, sentenced to jail 10 days, stayed 10 days for one year, one year unsupervised probation, no same or similar.

Tessa L. Petersen, 41, of Sherburn had a charge of animal-limitation of ownership continued for dismissal; one year unsupervised monitoring without conviction, by the end of the year the defendant must have 3 or less dogs in the residence as required by Sherburn city ordinance.
