Ryan T. Kelly, 51, of Fairmont received a statutory stay of adjudication on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $985, sentenced to jail two days, credit for time served two days, five years supervised probation, contact probation officer as directed, complete chemical assessment, follow all recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, maintain employment, cognitive skill training as directed by probation agent, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charges of driving after cancellation-inimical to public safety, possess/sale small amount of marijuana-no remuneration, and possession of drug paraphernalia-use or possession prohibited, were all dismissed.

Additional charge of driving while impaired-refuse to submit to chemical test-breath or test refusal or failure was dismissed.

Maguet, 33, of Minnesota Lake was convicted of aid and abet theft-take/use/transfer movable property without consent; fined $485, sentenced to jail 365 days, stayed 360 days for two years, credit for time served five days, two years supervised probation, pay restitution if filed within 30 days, contact probation officer as directed, complete chemical assessment if requested by probation agent, follow all recommendations of evaluation, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, obtain employment, maintain employment, cognitive skill training as directed by probation agent, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives.
