David Garcia Jr., 23, of Blue Earth was convicted of domestic assault-subsequent violation; fined $910, sentenced to jail 365 days, stayed 362 days for two years, credit for time served three days, two years supervised probation, contact probation officer as directed, no contact with victim(s), complete chemical assessment within 30 days and follow all recommendations, complete domestic abuse program approved by agent, can offset out-of-pocket expenses against fine, obtain permission from agent before leaving the state, no alcohol/controlled substance use with the exception of prescribed medications, random testing, defendant must report to Minnesota immediately per interstate compact tracking system, follow appropriate channels for transfer of probation to home state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives if prohibited by law. Additional charge of fifth-degree assault-inflict or attempt bodily harm was dismissed.

Benjamin L. Austin, 41, of Granada was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $865, sentenced to jail 365 days, stayed 335 days for two years, credit for time served two days, can serve remaining 28 days on EHM with alco-sensor at defendant’s expense, two years supervised probation, sentence to service eight hours for indeterminate, complete Faribault County drive with care program of treatment isn’t recommended in the chemical dependency evaluation, complete chemical assessment and follow all recommendations, no mood-altering chemicals including alcohol, random testing, attend MADD impact panel, contact probation officer as directed, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when when directed, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives if prohibited by law.

Nephtali A. Daza, 39, of Austin received a stay of adjudication on a charge of speeding; fined $125, one year unsupervised monitoring without adjudication, no speeding offenses, no same or similar.

Hodavias Gomez Gonzalez, 36, of East Bethel was convicted of speeding; fined $125. Also convicted of tires extending beyond fenders; fined $50.

Shane M. Collmann, 54, of Waterville was convicted of display cancelled/stolen/revoked plates; fined $385. Also convicted of driving after revocation; fined $200. Also convicted of possess or sale small amount of marijuana-no remuneration; fined $50.

Corinna F. Nielsen, 39, of Mankato was convicted of display cancelled/stolen/revoked plates; fined $385. Also convicted of possess or sale small amount of marijuana-no remuneration; fined $50.
