Kelly Pate, 34, of Fairmont was convicted on a felony charge of first-degree attempted assault-great bodily harm; commit to Commissioner of Corrections 87 months and 15 days, concurrent with other charges, restitution reserved for 30 days, pay restitution, if restitution is ordered it may be taken out of prison earnings, give a DNA sample when directed. Also convicted on a felony charge of first-degree arson of a dwelling; commit to Commissioner of Corrections 44 months, concurrent with other charges, restitution reserved for 30 days, pay restitution, if restitution is ordered it may be taken out of prison earnings, give a DNA sample when directed. Also convicted on a felony charge of second-degree arson; fined $41,554.91, restitution $41,554.91, commit to Commissioner of Corrections 33 months, concurrent with other charges, restitution reserved for 30 days, pay restitution, any restitution should be taken out of prison earnings, give a DNA sample when directed.

Also convicted on a felony charge of fourth-degree assault of a peace officer-throws/transfers bodily fluids or feces onto an officer; commit to Commissioner of Corrections 19 months, concurrent with other charges, restitution reserved for 30 days, pay restitution, if restitution is ordered it may be taken out of prison earnings, give a DNA sample when directed. Also convicted of possess small amount of marijuana-no remuneration; fined $50. Also convicted of possession of drug paraphernalia-use prohibited; fined $50.
