Forestry-open burning of prohibited materials — Anthony D. Christiansen, 39, of Welcome; fined $185.

Kaylee I. Kneale, 23, of Estherville, Iowa was convicted of failure of driver to carry proof of insurance when operating a vehicle; fined $200. Also convicted of driving without a valid drivers license for vehicle class or type; fined $185. Also convicted of speeding; fined $60.

Gavin W. Jensen, 37, of Fairmont received an amended court decision on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $1,085, commit to Commissioner of Corrections 366 days, concurrent with other case, supply DNA sample, fines and fees to be deducted from prison earnings if any. Also received an amended court decision on a charge of obstruct legal process-interfere with peace officer; fined $185, sentenced to jail 365 days, credit for time served 36 days, concurrent with other case, fines and fees to be deducted from prison earnings if any. Also received an amended court decision on a separate felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $85, commit to Commissioner of Corrections 13 months, concurrent with other case, supply DNA sample, fines and fees to be deducted from prison earnings if any. Also received an amended court decision on a charge of theft-take/use/transfer movable property without consent; sentenced to jail 90 days, credit for time served 36 days, concurrent with two other cases, pay restitution. Also convicted of a separate felony charge of fifth-degree controlled substance possession-not small amount of marijuana; commit to Commissioner of Corrections 366 days, concurrent with other case, supply DNA sample. Two additional felony charges of fifth-degree controlled substance possession-not small amount of marijuana, and a misdemeanor charge of possession of drug paraphernalia-use prohibited, were all dismissed.

Joshua R. Kain, 39, of Fairmont was convicted on a felony charge of domestic assault; commit to Commissioner of Corrections 15 months, stayed five years, sentenced to jail 38 days, credit for time served 38 days, five years supervised probation, sentence to service 10 days for indeterminate, follow all conditions set forth in the probation agreement, comply with all recommendations of chemical dependency evaluation dated 11/19/20, refrain from any type of assaultive, abusive or violent behavior, enter and complete inpatient chemical dependency treatment and follow all recommendations for extended care and ongoing sober housing programs, MCSO to transport on 12/21/20, complete a mental health assessment to further assess domestic violence prevention and follow all recommendations, no alcohol/controlled substance use, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Additional charges of fleeing a peace officer by means other than a motor vehicle, and contempt of court-willful disobedience to court mandate, were both dismissed.
