Failure to wear seat belt while in a motor vehicle — Amarante R. Torres, 72, of Winnebago; fined $110.

Driving without a valid drivers license for vehicle class or type — Roman Banda Jr., 28, of Fairmont; fined $185.

Joshua R. Kain, 38, of Fairmont was convicted of domestic assault-subsequent violation; sentenced to jail 365 days, stayed 336 days for two years, credit for time served 29 days, two years supervised probation, complete chemical assessment, follow recommendations of evaluation, participate in counseling at least twice monthly and/or as directed by a licensed therapist and follow recommendations to include specific domestic violence prevention classes, follow all instructions of probation, no alcohol/controlled substance use, random testing, remain law-abiding, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional felony charge of domestic assault was dismissed.

Joshua R. Thorson, 18, of Granada was convicted of purchase/sell/barter/furnish/give alcohol to persons under the age of 21; fined $85, sentenced to jail 365 days, stayed 360 days for two years, credit for time served five days, two years supervised probation, complete chemical assessment, follow recommendations of evaluation, follow all instructions of probation, no alcohol/controlled substance use, random testing, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charges of underage purchase of alcohol, underage alcohol possession, and underage alcohol consumption, were all dismissed.

Luis F. Vazquez Hernandez, 27, of Fairmont was convicted of driving while impaired-refuse to submit to chemical test-breath or test refusal or failure; fined $810, sentenced to jail 365 days, stayed 275 days for two years, credit for time served 16 days, serve balance of jail time on EHM with alco-sensor, two years supervised probation, follow all instructions of probation, attend MADD impact panel, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, report to agent as directed upon release from jail, complete chemical assessment, follow recommendations of evaluation, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charges of operate motor vehicle while under the influence of alcohol, driving after revocation, and failure of driver to carry proof of insurance when operating a vehicle, were all dismissed.
