Gavin W. Jensen, 36, of Fairmont was convicted on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $1,085, commit to Commissioner of Corrections 366 days, stayed five years, sentenced to jail 31 days, credit for time served 31 days, five years supervised probation, follow all conditions set forth in the probation agreement, take medications in the prescribed dosage and frequency and provide proof of prescribed medications to agent, obtain employment, maintain employment, complete chemical assessment within 30 days after release from jail and follow recommendations for care and aftercare, mental health evaluation or diagnostic assessment as directed by supervising agent and follow all recommendations for care and aftercare, obtain permission from agent before leaving the state, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give a DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote or vote until discharged from probation and civil rights are fully restored. Also convicted of obstruct legal process-interfere with peace officer; fined $185, sentenced to jail 365 days, stayed 335 days for two years, credit for time served 14 days, two years supervised probation, follow all conditions set forth in the probation agreement, take medications in the prescribed dosage and frequency and advise agent of all medications, complete chemical assessment within 30 days after release from custody and follow recommendations for evaluation, mental health evaluation or diagnostic assessment and follow all recommendations, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Also convicted of theft-take/use/transfer movable property without any consent; sentenced to jail 90 days, stayed 60 days for one year, credit for time served 14 days, one year supervised probation, follow all conditions set forth in the probation agreement, take medications in the prescribed dosage and frequency and make agent aware of all prescribed medications, complete chemical assessment within 30 days of release from jail and follow recommendations of evaluation, mental health evaluation or diagnostic assessment, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, pay restitution, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charges of fourth-degree physically assaults a peace officer, fifth-degree assault, disorderly conduct-offensive/abusive/boisterous/noisy/obscene, possession of small amount of marijuana-no remuneration, and obstruct legal process-interfere with peace officer, were all dismissed.
