Failure to wear seat belt while in a motor vehicle — Todd N. Gochanour, 53, of Fairmont; Nicholas C. Hudson, 29, of Truman; each fined $110.

Expiration of driver’s license for person over the age of 21 — Randy L. Howard, 62, of Fairmont; fined $185.

Driving after suspension — Dusty C. Klug, 38, of Fairmont; fined $285.

Failure of driver to carry proof of insurance when operating a vehicle — Ricky L. Durbin, 56, of Fairmont; fined $285.

Driving after revocation — Amber G. Carroll, 38, of Fairmont; fined $285.

Wayne R. Hasek, 59, of Fairmont was convicted of speeding; fined $125. Also convicted of failure to wear seat belt while in a motor vehicle; fined $25.

Jose L. Castano, 62, of Fairmont was convicted of harassment-violate restraining order within 10 years of previous domestic violence conviction/adjudication; sentenced to jail 365 days, credit for time served 27 days, concurrent with other case. Additional felony charge of attempted harassment-violate restraining order within 10 years of first of two previous domestic violence convictions was dismissed.

Randy A. Merrill, 48, of Fairmont received a statutory stay of adjudication on a charge of fifth-degree controlled substance possession-not small amount of marijuana; sentenced to jail three days, credit for time served three days, one year supervised probation, complete outpatient chemical dependency treatment through Fountain Centers in Albert Lea and follow recommendations for aftercare, complete a diagnostic assessment and cooperate with referrals for mental health case management, remain law-abiding, no alcohol/controlled substance use, random testing, obtain permission from agent before leaving the state, follow all conditions set forth in the probation agreement, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional felony charge of fifth-degree controlled substance possession-not small amount of marijuana, and a misdemeanor charge of possession of drug paraphernalia, were both dismissed.

Brett A. Smitherman, 36, of Fairmont was convicted on a felony charge of domestic assault; fined $585, commit to Commissioner of Corrections 18 months, stayed five years, sentenced to jail 60 days, credit for time served seven days, serve as work release if eligible, may work STS while in custody, five years supervised probation, sentence to service 15 days for indeterminate, obtain permission from agent before leaving the state, participate in a domestic abuse diagnostic assessment to determine appropriate recommendations of a specific domestic abuse program, counseling or education per statutory requirements, follow all conditions set forth in probation agreement, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, take medications in the prescribed dosage and frequency, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give DNA sample as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Two additional felony charges of domestic assault, and fleeing a peace officer in a motor vehicle, were both dismissed.
