Nickolas H. Willer, 31, of Fairmont was convicted on a felony charge of predatory offender-knowingly violates registration requirements or intentionally provides false information; fined $85, commit to Commissioner of Corrections 16 months, stayed five years, sentenced to jail 100 days, credit for time served 100 days, five years supervised probation, participate in an updated chemical health assessment and follow recommendations of evaluation, no alcohol/controlled substance use, random testing, cognitive skill training as directed by agent, provide list of prescribed medications to probation officer, obtain permission from agent before leaving the state, follow all conditions set forth in the probation agreement, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Two additional felony charges of predatory offender-knowingly violates registration requirements or intentionally provides false information, and predatory offender-fails to mail verification form within 10 days, and additional misdemeanor charges of failure to drive with due care-speed greater than reasonable, reckless driving-drives consciously disregarding a substantial or unjustifiable risk, possession of marijuana in a motor vehicle, and possession of drug paraphernalia, were all dismissed.
