Failure to wear seat belt while in a motor vehicle — Tony D. Weiss, 31, of Sherburn; fined $110.

Seth M. Kick, 26, of Fairmont was convicted of criminal vehicular operation-bodily harm with alcohol concentration .08 or more; fined $785, sentenced to jail 365 days, stayed 305 days for two years, credit for time served two days, serve as work release if eligible, serve 30 days in jail and 30 days on EHM with alco-sensor, two years supervised probation, restitution reserved, complete chemical dependency treatment programming and follow recommendations of evaluation, remain law-abiding, continue individual therapy until appropriately discharged, no alcohol/controlled substance use, random testing, attend MADD impact panel, obtain permission from agent before leaving the state, follow all conditions set forth in the probation agreement, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charges of second-degree driving while impaired-alcohol concentration 0.08 within two hours, second-degree operate motor vehicle under the influence of alcohol, criminal vehicular operation-bodily harm with gross negligence, and criminal vehicular operation-bodily harm while under the influence of alcohol, were all dismissed.

Mario J. Neither, 34, of Fairmont received a statutory stay of adjudication on a charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $825, sentenced to jail two days, credit for time served two days, one year supervised probation, complete chemical assessment, follow recommendations of evaluation, no alcohol/controlled substance use, random testing, obtain permission from agent before leaving the state, follow all conditions set forth in the probation agreement, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charge of possession of small amount of marijuana-no remuneration, was dismissed.

Darrel D. Ficken, 50, of Sherburn was convicted of driving while impaired; fined $785, sentenced to jail 90 days, stayed 88 days for one year, credit for time served two days, one year unsupervised probation, complete chemical assessment, follow recommendations of evaluation, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, attend MADD impact panel and pay costs, no same or similar.

Mikyla M. Christian, 22, of Fairmont received a stay of adjudication on a charge of sale of tobacco related device to children under 18 years of age-subsequent offense; fined $100, one year unsupervised monitoring without conviction, no same or similar.

Amber L. Engebretson, 42, of Twin Lakes received a stay of adjudication on a charge of failure of driver to carry proof of insurance when operating a vehicle; fined $200, one year unsupervised monitoring without conviction, no driving without insurance, no same or similar. Also convicted of wireless communications device-engage in cellular phone or video call; fined $135.
