Failure to wear seat belt while in a motor vehicle — Jonathon M. Bourne, 37, of Sioux Falls, S.D.; Herman V. Richter, 84, of Brewster; each fined $110.
Noel Lozano, 38, of Fairmont was convicted of fourth-degree operate vehicle while under the influence of alcohol; fined $610, sentenced to jail 90 days, stayed 89 days for one year, credit for time served one day, one year unsupervised probation, no same or similar, no alcohol criminal-related conduct. Additional charges of third-degree driving while impaired-refuse to submit to chemical test, open bottle law violation, and driving without a valid drivers license for vehicle class or type, were all dismissed.
April M. Rygh, 35, of Fairmont received a statutory stay of adjudication on a charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $500, sentenced to jail two days, credit for time served two days, one year supervised probation, remain law-abiding, follow all conditions set forth in the probation agreement, complete diagnostic assessment and follow all recommendations, follow all recommendations of the chemical dependency assessment completed 8/29/2019, provide list of prescribed medications to probation officer, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if changes address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charge of possession of drug paraphernalia was dismissed.
Dennis L. Jordan, 27, of Eden Prairie was convicted of speeding; fined $300. Also convicted of driving after revocation; fined $285.
Humberto J. Sauceda, 48, of Fairmont was convicted of driving after cancellation-inimical to public safety; fined $585, sentenced to jail 365 days, stayed 365 days for two years, two years unsupervised probation, no same or similar. Additional charge of give peace officer false name was dismissed.
