Joshua J. Knake, 32, of Sherburn received a stay of imposition pursuant to Minnesota statutes on a felony charge of first-degree damage to property-value reduced over $1,000; fined $590.36, restitution $505.36, sentenced to jail 26 days, credit for time served 26 days, five years supervised probation, pay restitution, chemical dependency assessment, follow all recommendations of evaluation, complete an updated diagnostic assessment and follow all recommendations of assessment and comply with mental health case management if qualified, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, follow all conditions set forth in the probation agreement, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored.

Oscar R. Arellano, 44, of Fairmont was convicted of theft-take/use/transfer movable property without consent; sentenced to jail 30 days, credit for time served 30 days.

Peter E. Best, 42, of Fairmont received a stay of adjudication on a charge of uninsured vehicle-driver violation; fined $848.35, restitution $848.35, one year unsupervised monitoring without conviction, pay restitution, no driving without valid drivers license and insurance, maintain insurance, no same or similar.

Gregory M. Green, 49, of Fairmont convicted on a felony charge of fourth-degree controlled substance possession-except marijuana with intent to sell; fined $1,085, commit to Commissioner of Corrections 24 months, stayed 15 years, sentenced to jail 44 days, credit for time served 44 days, 15 years supervised probation, obtain permission from agent before leaving the state, complete chemical assessment, follow recommendations of evaluation, complete diagnostic assessment and follow all recommendations of evaluation, follow all conditions set forth in probation agreement, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, provide proof of prescribed medications to supervising agent, obtain employment, maintain employment, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give DNA sample as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Also convicted on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $1,085, commit to Commissioner of Corrections 15 months, stayed five years, sentenced to jail 44 days, credit for time served 44 days, five years supervised probation, obtain permission from agent before leaving the state, complete chemical assessment, follow recommendations of evaluation, complete diagnostic assessment and follow all recommendations of care and aftercare, follow all conditions set forth in probation agreement, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, provide proof of prescribed medications to supervising agent, obtain employment, maintain employment, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give DNA sample as directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Two felony charges of third-degree controlled substance sales, and fifth-degree controlled substance possession-not small amount of marijuana, and three misdemeanor charges of vehicle window restrictions-tint too dark, possession of small amount of marijuana-no remuneration, and possession of drug paraphernalia, were all dismissed.
