Local man faces assault charge
FAIRMONT — A Fairmont man is facing a felony charge in Martin County. Jarod Ross Mathiason, 36, has been charged with one count of assault in the third degree, which carries a maximum penalty of five years in prison and a $10,000 fine.
According to the complaint:
At approximately 6:31 p.m. on January 28, 2021, Martin County Dispatch advised Fairmont Police Officers of an assault that took place at Live Fit & Wellness in Fairmont. Dispatch further mentioned that the alleged victim was at the ER and employees at Live Fit & Wellness have video of the assault. An officer acknowledged the call and proceeded to the location.
Upon arrival, the officer made contact with an individual who allegedly witnessed the incident. The individual told the officer that the alleged victim was working out in the free-weight area when a male, later identified as Mathiason, approached the man and punched him in the face. The individual stated that he saw Mathiason enter the building and that Mathiason appeared to be walking around the building as if he was looking for someone. The individual further stated that, following the incident, the man was bleeding from his left eye and both nostrils.
The officer reviewed surveillance video of the incident. In the video the man is seen in the free-weight area when Mathiason appears and walks around him, looking at him. The man then walks towards Mathiason before Mathiason removes his glasses and strikes the man in the face, hitting his left eye.
The officer made contact with the man, who described previous issues between himself and Mathiason. The man stated that, while he was at the gym, he noticed Mathiason and made a comment along the lines of “They let anybody in here,” at which point Mathiason removed his glasses and asked the man to repeat what he just said.
The man stated that as, as he repeated his statement, Mathiason punched him in the face, striking above his left eye, causing it to rip open and bleed. The man later stated that he needed three stitches to his eye.
Mathiason was later placed under arrest but was later released due to medical concerns.
