Derek L. Alvarez, 35, of Blue Earth was convicted of speeding; fined $145. Additional charge of failure of driver to carry proof of insurance when operating a vehicle was dismissed.

Derek L. Olson, 32, of Hartland received a stay of imposition pursuant to Minnesota statutes on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $835, sentenced to jail 30 days, credit for time served five days, serve as work release if eligible, serve balance of jail time on EHM at defendant’s expense, one year supervised probation, report to agent as directed, complete chemical dependency assessment and follow all recommendations, attend MADD impact panel, no mood-altering chemicals, no alcohol/controlled substance use with the exception of prescribed medications, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, agree to submit to random chemical testing, don’t enter bars or liquor stores or any establishment where the primary source of business is the sale or service of alcohol, take medications in the prescribed dosage and frequency, complete driving with care program, cognitive skill training as directed by agent, sign probation agreement, provide list of medications to probation officer, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if been charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, give a DNA sample when directed, sign releases of information as directed, don’t use or possess firearms, ammunition or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Also convicted of third-degree driving while impaired-one aggravating factor; sentenced to jail 365 days, stayed 335 days for one year, credit for time served five days, serve as work release if eligible, serve balance of jail time on EHM at defendant’s expense, concurrent with other charge, one year supervised probation, report to agent as directed, attend MADD impact panel, no mood-altering chemicals including alcohol, no alcohol/controlled substance possession with the exception of prescribed medications, random testing, don’t enter bars or liquor stores or any establishment where the primary source of business is the sale or service of alcohol, take medications in the prescribed dosage and frequency, complete driving with care program, cognitive skill training as directed by agent, sign probation agreement, obtain permission from agent before leaving the state, follow all state and federal criminal laws, contact probation agent within 72 hours if been charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed. Additional charges of possess over 1.4 grams of marijuana in motor vehicle, and limited license violation, were both dismissed.

Jerry L. Withers, 57, of Necedah, Wis. convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $610, sentenced to jail 90 days, stayed 88 days for one year, credit for time served two days, one year supervised probation, complete chemical dependency assessment and follow all recommendations, no mood-altering chemicals including alcohol, random testing, attend MADD impact panel, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed. Additional charge of open bottle law violation-possession was dismissed.

DISTRICT COURT

Speeding — Ralph Velez, 51, of Berwyn, Ill.; fined $125.

Jack P. Keil, 19, of La Crescent; fined $135.

Dylan L. Stevens, 18, of Ceylon was convicted of vehicle window restriction-tint too dark; fined $135. Also convicted of motor vehicle noise limits; fined $50.

Charles L. Herzog II, 51, of Middletown, Ohio received a stay of adjudication on a charge of speeding; fined $225, six months unsupervised monitoring without adjudication, no same or similar.

Scott D. Busse, 18, of Fairmont received a stay of adjudication on a charge of fourth-degree damage to property-intentional damage-other circumstances; six months unsupervised monitoring without conviction, pay $550 restitution within 90 days, no same or similar. Additional charge of disorderly conduct was dismissed.
