Animal nuisance-barking — Brian L. Johnson, 43, of Trimont; fined $135.

Wireless communications device-engage in cellular phone or video call — Paul A. Leimer, 65, of Truman; fined $135.

Driving without a valid driver’s license for vehicle class or type — Tommy O. Velasco, 20, of St. James; fined $185.

Keith E. Meyer, 59, of Fairmont was convicted on a felony charge of third-degree controlled substance possession-10 grams of more of a narcotic drug; fined $1,585, commit to Commissioner of Corrections 39 months, stayed 20 years, sentenced to jail 13 days, credit for time served 13 days, 20 years supervised probation, successfully complete the drug court program and follow all recommendations for care and aftercare, obtain permission from agent before leaving the state, follow all Rule 25 assessment recommendations which will include successful completion of outpatient treatment, care and aftercare, schedule intake with Fountain Center after sentencing, mental health evaluation as directed by agent and follow all recommendations for care and aftercare, cognitive skill training as directed by agent, no alcohol/controlled substance use, no alcohol/controlled substance possession unless prescribed by a licensed medical provider, random testing at the request of law enforcement or probation, take medications as prescribed and provide proof of prescribed medications to supervising agent, follow all conditions set forth in the probation agreement, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, give DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Two additional felony charges of third-degree controlled substance sales, possess ammunition/any firearm-conviction of adjudicated delinquent for crime of violence, and two misdemeanor charges of failure of driver to carry proof of insurance when operating a vehicle, and possession of drug paraphernalia, were all dismissed.

Cory J. Wickert, 36, of Fairmont convicted of third-degree operate motor vehicle under the influence of alcohol; fined $810, sentenced to jail 365 days, stayed 335 days for two years, credit for time served 20 days, two years supervised probation, complete chemical assessment, follow recommendations of evaluation, attend MADD impact panel, no alcohol/controlled substance use, no alcohol/controlled substance possession, random testing, obtain permission from agent before leaving the state, obtain employment, maintain employment, follow all conditions set forth in probation agreement, follow all state and federal criminal laws, contact probation agent within 72 hours if charged with a new crime; are in contact with law enforcement; if change address, employment, or telephone number, cooperate with search of person, residence, vehicle, workplace, property, etc. by probation officer, sign releases of information as directed, don’t use/possess firearms, ammunition, or explosives. Additional charge of third-degree driving while impaired-alcohol concentration 0.08 within two hours was dismissed.

Cole K. Wiebe, 36, of Fairmont was convicted on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $285, commit to Commissioner of Corrections 366 days, supply a DNA sample. Additional felony charge of first-degree burglary of occupied dwelling with non-accomplice present was dismissed.
