Levi S. Thate, 30, of Fairmont was convicted on a felony charge of fifth-degree controlled substance possession-not small amount of marijuana; fined $100, commit to Commissioner of Corrections 366 days, stayed five years, sentenced to jail 131 days, credit for time served 131 days, five years supervised probation, sentence to service 10 days for indeterminate, mental health screening, follow recommendations of evaluation, obtain permission from agent before leaving the state, follow all conditions set forth in the probation agreement, cognitive skill training, no alcohol/controlled substance use, random testing, obtain employment, maintain employment, follow all state and federal criminal laws, contact probation agent within 72 hours if you’ve been charged with a new crime; are in contact with law enforcement; if you change address, employment, or telephone number, cooperate with search of your person, residence, vehicle, workplace, property, etc. by your probation officer, sign releases of information as directed, give DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. Also convicted of theft-take/use/transfer movable property without consent; fined $100, sentenced to jail 365 days, stayed 90 days for two years, credit for time served 275 days, two years supervised probation, sentence to service 10 days for indeterminate, mental health screening, follow recommendations of evaluation, obtain permission from agent before leaving the state, pay restitution before fees, fines and surcharges, cognitive skill training, no alcohol/controlled substance use, random testing, obtain employment, maintain employment, follow all state and federal criminal laws, contact probation agent within 72 hours if you’ve been charged with a new crime; are in contact with law enforcement; if you change address, employment, or telephone number, cooperate with search of your person, residence, vehicle, workplace, property, etc. by your probation officer, sign releases of information as directed, give DNA sample when directed, don’t use/possess firearms, ammunition, or explosives, don’t register to vote until discharged from probation and civil rights are fully restored. An additional felony charge of fifth-degree controlled substance possession-not small amount of marijuana, and an additional misdemeanor charge of possession of drug paraphernalia, were both dismissed.

Hannah J. Johnson, 32, of Granada had charge of trespass-return to property within one year continued for dismissal; six months unsupervised monitoring without conviction, no entering Fairmont Walgreen’s, no misdemeanor or greater violations of the law.

Fabian Rivera Gonzalez, 26, of Fairmont was convicted of driving while impaired-alcohol concentration 0.08 within two hours; fined $610, sentenced to jail 90 days, stayed 90 days for one year, one year unsupervised probation, no alcohol/controlled substance use unless prescribed by a medical doctor, no alcohol/controlled substance possession unless prescribed by a medical doctor, random testing, attend MADD impact panel and pay fees, no same or similar. Additional charges of fourth-degree driving while impaired, driving while under the influence of alcohol, driving without a valid drivers license for vehicle class or type, and speeding, were all dismissed.

Joseph C. Rullestad, 30, of Fairmont was convicted of disorderly conduct-brawling or fighting; fined $185, sentenced to jail 30 days, stayed 30 days for one year, one year unsupervised probation, no same or similar.

Olivia D. Williams, 28, of Sherburn was convicted of theft-take/use/transfer movable property without consent; fined $285, sentenced to jail 90 days, stayed 90 days for one year, one year unsupervised probation, do not enter Fairmont Walmart, pay restitution if requested, no same or similar.
