Man faces felony charges

FAIRMONT — A Sherburn man is facing felony charges in Martin County.

Matthew Paul Holtz Jr., 25, has been charged with burglary in the second degree, which carries a maximum penalty of 10 years in prison and a $20,000 fine.

He has also been charged with harassment, violating a restraining order within 10 years of the first of two or more previous qualified domestic violence-related offense convictions. That charge carries a maximum penalty of five years in prison and a $10,000 fine.

According to the complaint:

At 3:20 p.m. June 10, a Sherburn police officer responded to a call of a heavily intoxicated male known as “Piggy” who was passed out on the front porch of a residence on South Main Street in Sherburn. The officer knew “Piggy” to be Holtz from prior police contacts, and believed he was currently on probation.

Upon arrival at the scene, the officer confirmed the male to be Holtz. Holtz was lying on his stomach on the front step, and a man who lived at the residence came outside and began talking to Holtz. Holtz was difficult to understand and his words were slurred.

Holtz requested the man give him a hot dog, and the man stated he had just given Holtz a pork chop and had told him to go home, something Holtz denied. The officer observed a fresh bone on the ground, and Holtz fell back asleep.

The man told the officer that Holtz had come over earlier and was buzzed, but he gave Holtz a couple of drinks and drank with him for a while. He said Holtz became too intoxicated and he wanted him to leave, so he told Holtz to eat a pork chop and then go home. The man said Holtz would not leave but kept hanging around the property.

The man then stated that at about 3 p.m., he looked outside and observed Holtz coming out of the residence south of his, holding a bottle of whiskey. The man was aware the residence belonged to a woman who had a harassment restraining order in effect against Holtz. The man said he called the woman, and she was upset that Holtz had been in her home and had taken her alcohol.

The man said the woman requested that he come to her home to see if Holtz had broken anything.

Holtz then woke up and went into the man’s house, and the officer followed him to find him sitting on a couch eating. Holtz was agitated and was rambling about “Let’s go” and “I’mma beat you.”

A Martin County Sheriff’s deputy arrived to assist, and Holtz was placed under arrest. The man at the house produced a bottle of whiskey and said it was the bottle that Holtz had taken from the woman’s house.

On June 11, the officer spoke to the woman on the phone, who confirmed the bottle of whiskey was the one taken from her home. A check on Holtz’s record shows that he has four prior domestic assault convictions since June 1, 2012.
