Fairmont man faces criminal sex charges

FAIRMONT — A Fairmont man is facing felony charges in Martin County.

Nicholas John Moeller, 18, has been charged with three counts of criminal sexual conduct in the third degree, each of which carries a maximum penalty of five years in prison and a $30,000 fine.

According to the complaint:

On March 27, a Martin County Sheriff’s deputy interviewed a 15-year-old female in regard to her relationship with Moeller. The girl stated she started hanging around with Moeller in May 2016, and stopped seeing him around February.

She said that around Oct. 28, Moeller drove her in his pickup to a gravel road just outside of Fairmont, and then parked the vehicle. She said they started to make out and eventually Moeller asked for sex. She said no. Moeller then allegedly proceeded to put his hand inside her pants.

The girl also said that in November, Moeller again drove her in his pickup to the same spot on the gravel road. The girl said she and Moeller both removed their clothes, and Moeller asked her to perform oral sex on him.

The girl said that in late January or early February, she and Moeller went to a park in Fairmont, where he repeatedly asked her to perform oral sex. She said he offered to give her $100, and she finally got sick of his asking and did what he wanted. She said Moeller did not actually pay her the $100.

On May 22, the deputy located Moeller in the parking lot of a bank in Fairmont. The deputy told Moeller he needed to talk to him about a case he was working on, and Moeller said he was too busy. The deputy then advised Moeller that if he did not come in and talk he would send his reports to the County Attorney’s Office for charging considerations. Moeller said he understood and would try to make it, but ultimately did not contact the deputy.

During the incidences described, the girl was 15 years of age and Moeller was 18 years of age.
